Colorado 811 “811 Yard Renovation” Social Media Contest (“the Contest”) “Official Rules”

1. NO PURCHASE IS NECESSARY TO ENTER, WIN OR CLAIM PRIZE. A purchase will not increase the chances of a person winning the Contest. 2. SPONSOR. The Contest is sponsored by Utility Notification Center of Colorado, DBA Colorado 811 (“Colorado 811”) 16361 Table Mountain Parkway, Golden, CO 80403, (303) 232-1991. 3. ELIGIBILITY. The Contest is open only to individuals legally residing in the state of Colorado who are at least eighteen (18) years of age at the time of entering the Contest. Employees of Colorado 811 as well as immediate family and household members of a CO811 employee, are not eligible to participate in the Contest. 4. AGREEMENT TO BE BOUND BY THE OFFICIAL RULES. Participation in the Contest constitutes each entrant’s full and unconditional agreement to these Official Rules and acceptance of the Official Rules. The decisions of Colorado 811 regarding the Contest, are final and binding. Winning a prize is contingent upon being fully compliant with these Official Rules and fulfilling all other requirements as set forth herein. 5. CONTEST PERIOD. The Contest begins on April 1, 2019 at 7:00 A.M. MST and ends on April 22, 2019, at 1 P.M. MST (the “Contest Period”). Entries received before or after the Contest Period as defined above will be disqualified. 6. TO ENTER. Entrants must submit a photo of a landscaped area or yard in Colorado in need of a makeover on the “Safe Digging Month Contest” page on Colorado 811’s website at www.colorado811.org. The yard or landscaped area in need of a makeover may be part of a residential or a commercial property or use (e.g., church, school, business). 7. PRIZE DETAILS. The Contest prize consists of cash, goods, or services, or a combination thereof, not to exceed $811.00, to be applied towards the cost of a yard makeover. The form of prize (e.g., gift card, check, etc.) shall be determined by Colorado 811, in its sole discretion. Colorado 811 will giveaway five prizes (see “Awarding of Prize”). 8. AWARDING OF PRIZE. On or after April 22, 2019, Colorado 811 will select one Contest winner from each Damage Prevention Liaison Territory area (Denver Metro, Northeastern Colorado, Northwestern Colorado, Southwestern Colorado and Southeastern Colorado. See territory map https://colorado811.org/damage-prevention/. Winners will be randomly selected through an online random selection method called a random generator of Colorado 811’s choice. All decisions by Colorado 811 relating to the Contest are final. The Contest winners will be notified by social media and/or email on or about one week following the Contest drawing. Except where prohibited, acceptance of the prize is consent to: (i) participate in a media event relating to the Contest, (ii) allow a line-locate service to locate any buried utility lines on entrants’ property, and (iii) the use of his/her name and/or photograph, all without further compensation for advertising, promotional and publicity purposes by Colorado 811. By accepting the prize, each winner acknowledges compliance with these Official Rules and consent to the conditions. 9. USE OF DATA. Winner and registrant’s personal information will not be shared with or sold to any third-party. 10. TAXES. Any valuation of the prizes stated above is based on available information provided to Colorado 811, and the value of any prize awarded to the Contest winner may be reported for tax purposes as required by law. The Contest winner is solely responsible for reporting and paying any and all applicable taxes. The Contest winner must provide Colorado 811 with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from Colorado 811 will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS. 11. OTHER CONDITIONS. All federal, state, and local laws and regulations apply. Colorado 811 reserves the right, at is sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual. By entering, participants agree to release and hold harmless Colorado 811 and other prize suppliers and each of their retailers, and each of the foregoing entities’ employees, officers, directors, shareholders, and agents (collectively the “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance or use of any prize or participation in any sweepstakes related activity and for any claims based on publicity rights, defamation, invasion of privacy and merchandise delivery. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any entry to be received by Colorado 811 due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in the sweepstakes or (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information. The use of third-party software or website or automated entry systems to participate is prohibited, and Colorado 811 reserves the right to disqualify entries made in such a fashion. By entering, entrants agree to comply with these rules. Any entrant who attempts to tamper with this Contest in any way shall be disqualified. This contest is in no way administered by, or associated with, Facebook. Additional restrictions may apply. 12. DISPUTES. Entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes or any prizes awarded shall be resolved individually, without resort to any form of class action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of the entrant and Colorado 811 in connection with the sweepstakes, shall be governed by and construed in accordance with the laws of the State of Colorado.
